Drunk driving is a serious criminal offense! Let’s eradicate drunk driving.

“I will never drive under the influence of alcohol nor let others do it! I will never tolerate drunk driving nor turn a blind eye to it!”

 To eradicate seriously prevalent drunk driving, Fukuoka Prefecture has enacted a drunk driving eradication ordinance with penalties. Please note that all citizens must report drunk driving to police officers when they witness it.
 It is important that the citizens, businesses, and government of Fukuoka Prefecture work together to create a society where people can live safely without drunk driving.

1. Key contents of the ordinance

(1) Responsibilities of citizens

  • Never drive under the influence of alcohol for any reason.
  • Do not let your family members or friends drive while drunk.
  • If you witness drunk driving, call 110 (the police).

[If you are arrested or admonished for drunk driving]

If you are admonished for drunk driving at an alcohol level below the threshold* (for the 1st time):

You must try to seek advice and guidance to tackle drunk driving.
*Alcohol concentration in exhaled breath of 0.15 ml/g or more

If you are arrested (for the 1st time) or admonished (for the 2nd time):

You must receive a medical examination for alcoholism or get guidance to tackle drinking.

If you are re-arrested or admonished in 5 years:

You will be ordered to see a doctor to treat your alcoholism. (If you do not follow the order, you will be penalized with a fine of up to 50,000 yen.)

(2) Responsibilities of businesses

  • Confirm that your employees are not under the influence of alcohol when driving.
  • Specific Business Operators*, owners of buildings with eateries among their tenants, and organizers of large-scale events where participants may drink should post educational material, such as posters on the eradication of drunk driving.
  • In order to prevent customers from driving while drunk, restaurants and other eating establishments should check with their customers whether they came by car and introduce a proxy driving service if it is necessary. Also, if a particular person is designated as a driver, do not serve him/her alcohol.
  • Specific Business Operators* and their employees, event organizers and their employees, and the drivers of taxi operators or proxy driving services shall prevent their customers, event participants and users from driving under the influence of alcohol. In addition, if they witness drunk driving, they should call 110 (the police).
  • Specific Business Operators*, taxi operators, and proxy driving services should provide their employees with training to make them aware of the importance of reporting drunk driving.

*Specific Business Operators: The operators of an eating establishment that serves alcohol, liquor distributors and parking lot owners/managers.

[Business] If its employee or associated party is arrested for drunk driving:

The organization that the arrested party belongs to will receive notification from the Public Safety Commission.

The organization that receives the notification must provide training, guidance, etc. to the party concerned to prevent recurrence.

[Restaurant or other establishment where food and drink are served] If its customer is arrested for drunk driving:

If any of its customers is arrested again in one year and the restaurant does not follow the instruction of the Public Safety Commission that orders it to take appropriate measures to prevent drunk driving.

The authority will name and shame the defying restaurant and give an order that it shall put up an administrative order within the premise.

If the restaurant does not put up the order, it will be penalized with a fine of up to 50,000 yen.

2. Drunk driving is a criminal offense. Offenders will also be punished under the Road Traffic Act.

(1) Drunk driving

Penalty: Imprisonment for up to 5 years or a fine of up to 1 million yen
Administrative sanction: Revocation of driver’s license

(2) Drunk driving (with a less degree of alcohol concentration)

Penalty: Imprisonment for up to 3 years or a fine of up to 500,000 yen
Administrative sanction: Revocation or suspension (90 days) of driver’s license

(3) Others

If you injure or kill a person while drinking and driving, you may be sentenced to 20 years in jail under the “Act on Punishment of Acts Inflicting Death or Injury on Others by Driving a Motor Vehicle, etc.”

3. For those who are concerned whether people close to them might drink and drive
